House to Astonish Episode 98

We’ve a nice little hour and a quarter of comicy chat for you this time out, with discussion of Titan’s new comics line, the Phoenix going digital, the proposed DC “dark” movie, the SHIELD and Hulk TV shows and the Superman appeal decision. We’ve also got reviews of The End Times of Bram & Ben, Superior Spider-Man and Mara, and the Official Handbook of the Official Handbook of the Marvel Universe is suffering from an inferiority complex. All this plus Batman’s successful plastic surgery, an epidemic of constipation and a small cat caught in the middle of a war between estate agents and bacon.

    Smallville — It gives you hope that something amazing will happen, and then lets you down, and then gives you hope again…. it’s an odd rollercoaster of fanboy emotions…. They had Booster Gold on once.

    I got into comics in 2002, right when Chuck Austen began his run on Uncanny, and Uncanny was the only X-book I was reading. When I dropped the book at the time of the evil communion wafers, I switched to The Avengers. So, for a significant portion of the mid-2000s, I thought Chuck Austen was an average representative of comic book writing.

    The otto/ peter thing reminds me both of the old quality/dc character captain triumph and/or the rick jones/mar-vell shazam version.

    “Well, it’s kind of a story.” Who told you DC’s in-house slogan for the New 52?

    I can’t believe I have this level of encyclopedic knowledge of Smallville (actually, yes I can, I just wish I didn’t) but when Aquaman was introduced, it was still set in Smallville. Not that Paul’s point would be any less valid if it wasn’t, because in Smallville, Metropolis is in Kansas, or at least less than an hour’s drive from Smallville. I think that episode was mostly set around The Ol’ Swimming Hole.

    Paul, if you think Smallville-Hawkman’s costume is dumb based on still images, what if I were to tell you that, when (SPOILERS!) he dies, the light in his chest symbol goes out, like he’s powering it through his bio-energy or something?

    One of the advantages of following the Panini reprints is that when you guys discuss Marvel it’s like I’m getting an in-depth preview a year in advance. I wasn’t sure about whether I’d continue with Astonishing Spider-Man when it started running Superior, and now I’m intrigued.

    I honestly saw someone on the net say something to the effect of “Peter’s a ghost, that proves he’s really dead!”

    Gambit-style head-frames were also inexplicably popular among the New Gods. Lightray is probably the classic example, but there were also a couple of Forever People.

    Given Scott Lobdell’s career has been resurrected over at DC, perhaps we’re threatening to have a Chuck Austen revival on our hands sooner rather than later.

  13. I honestly preferred Smallville’s early wacky-meteor-freak-of-the-week approach. There were some total duds in there (Kryptonite Chewing Gum???) but it was all worth it for the Clark-Lex-Lionel interactions. Once it started REALLY rooting around in the DC mythology (with Poundland costumes) it lost me. I kept trudging on until Season 8 or 9 but I didn’t even go back to see Welling in the Superman costume in the finale.

    Marilyn, let’s not even dare write it. It’s my understanding that if you say the name “Chuck Austen” three times in front of a mirror, he gets to write the next Wonder Woman relaunch.

    At least if they chucked Constantine into a JLD movie he wouldn’t have as much screen time for character destruction.

    That said I was thinking the other day that Simon Baker who plays Patrick Jane in The Mentalist would make a great John Constantine.

    Britney Spears has done that noise for at least a decade (yes! You are old!). She may or may not have nicked it from Shakira, but it’s a bit common. It’s a “sexy” noise you see, comes from making a baby coo while pressing your tongue against the inside of your bottom lip to cover your lower teeth and make your mouth a more inviting wet hole.

    On another note altogether, if Ryan Stegman was actually in the Marvel Universe, he would quickly have some kind of lab accident that would cause him to grow a long spiked dinosaur tail and back plates.

    I think you guys are wrong about several aspects of the Siegel case, at least so far as can be determined by the publicly available documents. I have to dig some of them out and re-read them, but a few quite matters.

    I don’t think the status of the acceptance letter as a binding agreement is nearly as open and shut as you seem to think, considering it took DC over a decade to find some judges who agree with that (and that largely depended on precedence from a Facebook case, a company which didn’t even exist when the acceptance letter was written). They’re just lucky those might turn out to be the last judges to rule on the matter. And I don’t think you can dismiss the Siegel allegation that the contract they refused to sign contained elements they objected to that were not in the document the acceptance letter referred to. I’d have to compare them, but I do recall that the later contract had some elements that I didn’t blame them for not agreeing to.

    I think if you’re going to criticize a lawyer for ill-serving a client, it should be the Siegel’s pre-Toberoff counsel. The offer they got from DC and wanted the Siegels to accept seems so absurdly low that I can’t believe it took several years for them to get that far. How low must DC’s original offer have been? A second payment of the $65 to match Siegel’s half of the original 1938 purchase price?

    And ironically, Smallville was the WB Network’s first attempt to replicate its success with Buffy‘s highschool-plus-superpowers formula. Only, you know, without the wit and intelligence.

    Still, as alluded to in an above post, the series enjoyed an intriguing all-but-in-name platonic gay romance subplot between Clark and Lex that made it fun to watch in the early years. When they introduced Lois Lane the series turned decidedly hetero, which really killed the enjoyment, IMO.

    They never showed Welling on camera wearing the suit. The closest they got was a tiny CGI Superman in flight.

    It was Brandon Routh’s suit, anyway, and I’m sure the producers didn’t want to spend the money to tailor it to Welling.

    If Smallville had be a 4-5 season series as planned, I think I would have liked it more.

    But it was too popular for its (various) desperate network owners to let die. Even when the CW was rebranded to exclusively target a young woman audience (a move that led to the cancellation of Reaper, despite its ratings), Smallville survived.

    And thus the writing kept dragging on. The first few seasons were doing a slow growth and turning of Lex (paced for 4-5 seasons), but suddenly the show had no end in sight. The Smallville setting led to a similar problem, as did the mandate to not show Superman in costume.

    Tess Mercer all but wagged her tail whenever she was in a scene with another woman, especially at the start. None of the relationships she had with men were half as convincing as the bristley way she was around Lana.

    The series was pretty heavily aimed towards young women from the start. Remember the comparisons with Dawson’s Creek? Plenty of model-pretty boys+, extended soap-opera subplots, e.g.: love triangles (apologies for that generalisation, but I think it still holds water, doesn’t it?), plus all the fantasy stuff that True Blood, Twilight, that one show that isn’t Fables and Honey Boo Boo came to trade on.

    Hell, Lana turned out to be a reincarnated witch princess or something – and even had a badwig flashback letch over a teenage Jor-El, who had come to Earth to name Jonathan Kent in the womb, fanfic-fanfic. The fact that they ended up bringing in an actress who was fine with bikinis every other week after four seasons of sensible turtlenecks* suggests a desire to keep hold of the lady-liker demographic. It was happy chance that Erica Durance ended up being the only actor worth watching, as well.

    On Super Spider-Man TV Comic 1: make sure you read Avenging Spider-Man 15.1, as it’s pretty essential in terms of setup for both the new status quo and the “holy smokes, it’s Miles Morales!” cliffhanger (tee hee). It should have been the first half of a double-sized ish 1 (and definitely ought to be chapter one of the trade).

    On The Phoenix: The Dandy has also made the transition to digital now, with content including revamped/restored favourites, and British superhero strips Bananaman and RetroActive. Dandy dot com for that.

Shirtless on a crucifix!), Lex, Whitley-Flash Thompson/Gordon, Lana’s PE Teacher, AC, Shirtless Ollie Arrow, Helo, Doomsgoddamnday(lotta brooding brunettes), Adam DefinitelyNotBatman, Grant CloneTeeth, Legion ElectroBerk, Cyborg, ZOD!!, JAMES MARSTERS!!!. Hell, even Jonathan Kent was a dishy Dad all dressed in plaid! Meanwhile, nerdlingers Pete & Proto-Jimmy Olsen get the buuuum’s ruuuush.)

    That’s not correct. The court does indeed cite Facebook v Pacific Northwest – http://cdn.ca9.uscourts.gov/datastore/opinions/2011/04/11/08-16745.pdf – as authority for the proposition that a contract can be enforceable even if the parties envisage entering into a more detailed agreement, so long as what they HAVE agreed was intended to be legally binding and is sufficiently certain to be enforceable.

    But that rule doesn’t ORIGINATE in the Facebook case – it’s just basic contract law, being applied to a particular situation. In fact, the Facebook case treats it as settled law, and the Siegel court also cites a case from 1999 as authority for the same point. I would guess that the main reason for citing Facebook rather than an earlier decision is that it’s a recent decision of an appellate court, and it’s relatively close on the facts. But it’s nothing new.

    It’s not just the issue of whether a tentative agreement in advance of a more detailed agreement can be binding, but whether this particular one was. DC’s been arguing that it was for over a decade to no avail, I believe even with testimony from the Siegels’ lawyers.

    Not that the precedent matters all that much. As Bush v. Gore demonstrated, judges (on both sides of the issue) can approach a decision from their desired outcome and work backwards from there to establish a rationale.

    And again, I’ll point the blame to that pre-Toberoff counsel. How hard would it have been to put in that letter “we agree, pending acceptable final contract language”?

    I remembered Marvel having another character named Grizzly – a bear-themed Spider-Man villain who fould Deadpool a few times too – and upon checking Wikipdedia to make sure I wasn’t just imagining it, I discovered that Marvel’s actually had four different characters named Grizzly (six if you include the Age of Apocalypse version and, I kid you not, Ultimate Grizzly).

    As for Smallville, what always baffled me was that Superman was a guy in a blue shirt and red jacket, aquaman was a guy in an orange halter top and green shorts, Cyborg had no visible metal parts, Green Arrow and the Flash were guys in color-coded hoodies, and Martian Manhunter was a normal-looking guy in a green dress shirt and red suspenders (or braces, I believe you call them in the UK – the things that hold your pants up) while Hawkwman was just full on cosplaying.

    In fact, most of the JSA members who showed up looked like someone trying to win a convention costume contest, while virtually anyone else from the comcis looked like when the Power Rangers were in their secret identities and they always made sure to have them wear at least one piece of clothing of the same color as their combat outfit.

    That’s sort of Hawkman’s thing though. He’s old school and proud. It makes sense that he’s the only one dressed like a superhero in the classic sense. Show these kids how it’s done.

    Not that it matters but Domino killed Grizzly in an early issue of Cable (15-35). It was implied that he was being controlled by someone (we never find out who. I always thought Onslaught given that he was pretty behind everything at the time), but after arguing/fighting for an entire issue, she kills him off-panel.

    Yeah, that’s not a bad casting. However, I still believe that the best Constantine is a young Kiefer Sutherland. Check him in the movie “Flatliners”.
